Privacy Policy

1. Information Collection:

GlobiSport collects the following types of information:

• Personal Information: Information that can be used to identify you, such as your name, email address, physical address, location, contact information, payment details, and profile photos. [Reference: POPIA Section 11(1)(a)]  
• Sporting Information: Information related to your sports activities, such as your sports, role, level, achievements, goals, training history, and performance data. This information is collected for the purposes of matching users with coaches, event organizers, and other relevant individuals/organizations, as well as for providing personalized content and recommendations. [Reference: POPIA Section 7]
• User Content: Content you post or share on the Platform.
• Usage Data: Information about how you use the Platform, such as the pages you visit, the content you interact with, and the features you use.
• Device Information: Information about the device you use to access the Platform, such as your IP address, browser type, and operating system.
• Cookies: GlobiSport uses cookies to enhance user experience. The Platform employs the following types of cookies:
  • Essential Cookies: Necessary for the Platform to function (e.g., session management).
  • Analytics Cookies: Used to analyze website traffic and user behavior (e.g., Google Analytics).
  • Marketing Cookies: Used to personalize advertising and track marketing campaign effectiveness. Users will be presented with a cookie banner upon visiting the Platform, allowing them to provide informed and specific consent to the use of non-essential cookies. [Reference: POPIA Section 36]

2. Use of Information:

GlobiSport uses your information for the following purposes:

• To provide and personalize the Platform.
• To connect you with other users.
• To facilitate transactions.
• To analyze Platform usage and improve its functionality.
• To communicate with you about the Platform (e.g., updates, notifications).
• To provide personalized marketing communications only if you have opted in.
• To comply with legal obligations.
• Legal Bases for Processing: GlobiSport processes personal information based on the following legal grounds:
  • Consent: Where you have given explicit consent.
  • Contract Performance: Where processing is necessary to fulfill a contract with you.

• Marketing: Marketing communications require opt-in consent. Users can unsubscribe via links in marketing emails or through their account settings. [Reference: POPIA Section 13]

3. Sharing of Information:

GlobiSport may share your information with:

• Other users of the Platform (depending on your privacy settings). Users should be able to control the visibility of their information.
• Service providers (operators) who assist GlobiSport with operating the Platform (e.g., hosting, payment processing, marketing). GlobiSport requires these operators to sign POPIA/GDPR-compliant contracts, ensuring they adhere to data protection standards. [Reference: POPIA Section 71]
• Law enforcement or government agencies if required by law.
• International Transfers: Data may only be transferred to countries with “adequate protection” (as determined by the Information Regulator) or with explicit user consent. [Reference: POPIA Section 3]

4. Data Security:

GlobiSport takes reasonable and appropriate technical and organizational measures to protect your information from unauthorized access, use, or disclosure. These measures include encryption, access controls, and regular security audits. 5. Data Retention:

GlobiSport retains your information for 3 years post-account deletion unless a longer retention period is required by law. [Reference: POPIA Section 7]

6. Your Rights (POPIA):

You have the right to:

• Access your personal information.
• Request correction or deletion of your personal information.
•  Object to the processing of your personal information. 
• Request the transfer of your personal information to another provider (data portability).  
• Lodge a complaint with the Information Regulator.

Exercising Your Rights: You can exercise these rights by submitting a Data Subject Access Request (DSAR) form, which is linked in the Platform footer. [Reference: POPIA Sections 6 and 7] GlobiSport will respond to your requests within 21 days. [Reference: POPIA Section 11]

7. Children’s Privacy:

The Platform is not intended for children under the age of 18. Parental/Guardian consent is required for users under 18. GlobiSport will implement age verification mechanisms during registration. [Reference: POPIA Sections 8 and 11] Specific provisions will be in place for managing and protecting the data of users under 18. These provisions will include clear guidelines on what information is collected, how it is used, and how parents/guardians can control their child’s account.

9. Changes to Privacy Policy:

GlobiSport reserves the right to change this Privacy Policy at any time. Users are responsible for reviewing this Privacy Policy periodically. Notification of material changes will be provided via email and/or through a prominent notice on the Platform.

10. Definitions:

• “Personal Information” means information relating to an identifiable, living natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to:
  • Information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;  
  • Information relating to the education or the medical, criminal or employment history of the person;  
  • Any identifying number, symbol or other particular assigned to the person, such as a name, identification number, passport number, bank account details, telephone number, cell phone number, e-mail address, physical address, postal address, biometric information, online identifier or other identifier;  
  • The personal opinions, views or preferences of the person;
  • Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
  • The views or opinions of another person about the person; and  
  • The person’s name if it appears with other personal information relating to the person or if the disclosure of the name itself would constitute the disclosure of personal information.  
• “Processing” means any operation or activity or any set of operations, whether or not by automatic means, concerning personal information, including—
  • the collection, receipt, recording, organisation, collation, storage, updating or modification of information; 
  • the retrieval, alteration, consultation or use of information;
  • dissemination by transmission, distribution or making available in any other form; or
  • merging, linking, as well as blocking, degradation, erasure or destruction of information.  
• “Data Subject” means the person to whom personal information relates.
• “Information Officer” means the person designated by GlobiSport who is responsible for ensuring compliance with POPIA.
• “Operator” means a person who processes personal information for a responsible party in terms of a contract or mandate, without being under the direct authority of such responsible party.  
• “Responsible Party” means a public or private body or any other person who, alone or in conjunction with others, determines the purpose of and means for processing personal information.
