1. Terms and Conditions
2. Acceptance of Terms:

• Users must explicitly acknowledge acceptance of these Terms and Conditions (“Terms”) and the Privacy Policy (“Policy”) via a checkbox or button during registration. A layered notice will link to the full T&C and PP for transparency. [Reference: POPIA Section 10]
• Continued use of the GlobiSport web app (“Platform”) after updates constitutes acceptance of the revised Terms. Users will receive email notifications for material changes. [Reference: POPIA Section 6]

2. User Accounts:

• Users are responsible for maintaining the confidentiality of their account credentials.
• Users are responsible for all activities that occur under their account.

• Users must provide accurate and complete information when creating their account.
• Two-factor authentication (2FA) is recommended for enhanced security. [Reference: POPIA Section 7]
• Users must notify GlobiSport immediately of any unauthorized account access. [Reference: POPIA Section 1]
• GlobiSport reserves the right to suspend or terminate accounts for violations of these Terms.

3. User Content:

• Users are solely responsible for the content they post or share on the Platform (“User Content”).
• Users represent that they have all necessary rights to their User Content.
• Users grant GlobiSport a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute their User Content solely for the purpose of enabling the Platform’s functionality (e.g., displaying listings, profile information). This license does not extend to using User Content for marketing purposes without explicit consent.
• Users must obtain consent before posting others’ personal information (e.g., team member contact details). [Reference: POPIA Section 11]
• Users agree not to post any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

• GlobiSport reserves the right to remove any User Content that violates these Terms.

4. Platform Use:

• Users agree to use the Platform only for lawful purposes.
• Users agree not to:
  • Impersonate any person or entity.
  • Interfere with or disrupt the Platform’s servers or networks.
  • Attempt to gain unauthorized access to any part of the Platform.
  • Use the Platform to distribute spam or other unsolicited communications.
  • Infringe on any intellectual property rights.
  • Reverse engineer, scrape, or perform automated data extraction from the Platform without prior written permission. [Reference: POPIA Section 6]
• Users agree to comply with all applicable laws and regulations.

5. Development Hub (Content, Products, & Services):

• Listings: Users can list content, products, and services for sale. Listings must be accurate and complete, complying with all relevant consumer protection laws.
• Transactions: All transactions are subject to a 10% transaction fee. GlobiSport may mediate disputes between buyers and sellers but is not liable for third-party transactions. [Reference: Consumer Protection Act Section 37]
• Intellectual Property: Sellers represent they own or have the right to sell the listed content, products, or services.
• Reviews: Users can rate and review listings. Reviews must be honest and based on genuine experiences.

6. Messaging & Communication:

• Users are responsible for the content of their messages.
• Users agree not to send spam or harassing messages.
• GlobiSport may monitor messages for violations of these Terms.
• Users may opt out of marketing communications via their account settings. [Reference: POPIA Section 11(1)(c)]

7. Intellectual Property:

• The Platform and its content are owned by GlobiSport and are protected by copyright and other intellectual property laws.
• Users may not use any content from the Platform without GlobiSport’s prior written consent.
• Users may report copyright violations via a designated portal on the Platform. [Reference: Copyright Act]

8. Governing Law:

• These Terms shall be governed by and construed in accordance with the laws of South Africa.
• Disputes will be resolved in South African courts, with adherence to POPIA and the Consumer Protection Act. [Reference: POPIA Section 11]

9. Disclaimer of Warranties:

The Platform is provided “as is” without any warranties of any kind, either express or implied.

10. Limitation of Liability:

GlobiSport shall not be liable for any damages arising from users’ use of the Platform, except where such liability cannot be excluded by law.

11. Changes to Terms:

GlobiSport reserves the right to change these Terms at any time. Users are responsible for reviewing these Terms periodically. Notification of material changes will be provided via email.
